This is his ability to create a valid and logical theory by careful observation on the surroundings and affect of a person. As a private detective with deductive reasoning, Holmes can identify what and where Dr. Watson was earlier, a civilian's job, or a past employee of a mining company. Though they are not usually wearing a gentle-looking coat and tie, their work are not done in a sloppy manner. Their hands should always be in cogitation. One ataxic moment and boom! The precious bone might be destroyed. So rummaging has been deleted from their dictionary; softness has been the mantra (so as not to destroy any important bone). After the stressful process of unearthing bones (if ever they are buried), the next step is careful scrutiny. First there will need to be a jury. The jury isn't automatically appointed or random. The jury is chosen from a pool of randomly nominated people. Then after a jury is convened, opening statements will be made. The attorneys take turns doing this. After opening statements comes testimony. In testimony, victims and witnesses present their story of what happened. They can tell about what they experienced, and also what they saw.

Either side may choose to cross-examine witnesses in testimony. When this happens, an attorney attempts to show that the facts presented by the witness are not trustworthy, either because the witness was confused, is biased, is lying, or could not have had the knowledge they claim. Data is thereby questions and reviewed, and attempts are made to refute facts presented.

Next are closing arguments. Both sides give a closing. Each summarizes their case. This is done at the very end, and it is the last presentation that is made before the jury leaves to debate and vote.

Taken together, these steps are meant to give the jury all the information it needs to understand what happened in the case. Jury members are expected to impartially examine the available data, and to weigh the relative merits of each side's arguments. Then the jury votes on which side made their case and whether the defendant is to be held liable.

When the jury has decided this they will then give their ruling to the court. In most states it has to be a unanimous decision with all jurors agreeing. In states that this is not required, there still must be an overwhelming majority, of 9 to 3 or better.

Furthermore, the prosecutor must persuade the jury or judge "beyond a reasonable doubt" of each fact required to constitute the crime charged. In civil cases, the plaintiff has to demonstrate a defendant is liable only by a "preponderance of the evidence," or more than 50%.

The primary problem with our Congress is that it has increasingly become a collection of career politicians rather than a body representative of its constituency. As a result, the overriding concern of the average Senator or Congressman is increasing the power that he is able to wield, and as a result the power that his body is able to bring to bear.

The Federal prohibition of sports wagering which was enacted a few years back is of very dubious Constitutionality. Were it not for the grandfather clause, which allowed it to remain legal in jurisdictions in which it already existed, it would have certainly been struck down as unconstitutional on a number of different fronts. Ironically, the gambling industry supported this bill in the pre-Internet era.

Unfortunately, the mere fact that a proposed law or initiative is unconstitutional offers little protection for the citizenry. In fact one of the most important concepts in the Constitution"that of the right to sovereignty and self-determination of the individual states"is one of the most frequently abused. For those of you not up on the Constitution (and if youre not, you certainly should be), lets consider the 10th Amendment:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Under the 10th Amendment, unless the power in question has been expressly given to the Federal government by the Constitution, and/or unless it has expressly been prohibited to the states to govern as it sees fit. If an individual state chooses not to regulate a certain activity, it is the right of each individual citizen to make their own decision.

So, you should be asking yourself at this point, where exactly does the Constitution delegate to the Federal government the right to make policy on sports gambling? The answer is that it doesnt, and it is very questionable that they have the Constitutional authority to do so. Fortunately for all freedom loving Americans the founding fathers would beg to differ.

The entire premise of a social contract between a government and the governed is that individuals give up a certain degree of personal liberty for a certain degree of protection. The problem is that too many Americans are willing to give up just about any freedom for even the illusory promise of protection. If theyre not personally willing to cede this freedom, theyre often indifferent or unconcerned about it. The danger to broader concepts of personal liberty may seem a million miles away, but with each additional law intended to protect us from this or that the Federal government becomes larger and more powerful and the rights of the sovereign states"and the individuals that comprise them"are shrinking and being weakened.

A San Carlos, CA wastewater and sewer service provider recently wound up on the losing end of a legal case brought by a San Francisco area group that claimed the utility allowed too many 'overflows' of raw, untreated sewage that found its way into San Francisco Bay. Following settlement of the suit, the utility is now preparing its customers for another rate increase as the settlement requires increased spending for maintenance programs and staff. In the end, the cost of additional maintenance personnel will be passed through to customers.

Wastewater Utility Consultants provide extensive help to utilities in avoiding treatment system failures. However, this might be one instance where the utility cut its maintenance costs only to get hit with a lawsuit for failing to properly maintain its systems. And the costs of this legal action will only increase the operating costs that the utility was originally trying to reduce.

Costs to prevent additional spillage or "overflow" events appear to mean another cost increase to the San Carlos consumers. Additional salaries and expenses necessary to meet the settlement requirements could result in a 7% increase in customer service rates.

So as maintenance budgets are reduced to keep rates low, the chances for problems can increase significantly. Settlement costs to recover from these problems simply add to the operating expenses and cost structure - which inevitably are passed on to customers.

What are utility and service providers to do? Educating customers about the input and cost items that drive their rates up is one method. However the major tool water and wastewater service providers utilize is assembling a viable financial plan. Back in San Carlos, customers have seen their service rates nearly double since 2005. Meeting every challenge with a rate increase though is a difficult and ineffective way to manage a utility organization. A long term financial plan can both explain to customers why their rates are structured in a certain fashion as well as provide a reasonably predictable cost model for future years.

Water and sewer rate increases may not be inevitable, but for many utilities, they are difficult to avoid when an unexpected disaster strikes or a court case is lost. Close Race For The Las Vegas Justice Of The Peace

An election for the Las Vegas Justice of the Peace Department 3 position is getting competitive. 58 year old Lary Lamoreux, and 48 year old Janiece Marshall, both attorneys from the Las Vegas area, are challenging incumbent Tony Abbatangelo. As the election draws near, the race to unseat the 17 year incumbent is starting to get very heated.

Justices of the Peace are in place to prepare procedural aspects of cases before they move onto District Court. For example, they might set bail and handle arraignments. In addition, Justices also preside over small claims civil cases and misdemeanor cases.

A significant stain on the record of the incumbent has been used against him in this election. Following a no contest plea to one count of misdemeanor battery domestic violence last year, Tony Abbatangelo was sentenced to 6 months of community service and domestic violence counseling.

As part of his Justice of the Peace duties, Abbatangelo recently granted bail to an attempted murder defendant. The $7500 bail amount was a small fraction of the $100,000 bail amount that is usually set for attempted murder suspects. The defendant fled and critics are citing this as a mistake by Abbatangelo from the bench.

At the heart of the controversy surrounding the defendant's bail jump is the fact that this defendant is represented by the same attorney that represented Abbatangelo in his domestic violence case. Critics are pointing to this as another reason to not reelect Abbatangelo.

All is not lost for Tony Abbatangelo. He can cite a very good rating in the Judicial Performance Evaluation survey as a strength to his candidacy. In addition to 17 years as a Justice of the Peace, the incumbent also enjoys the advantage of having raised the most campaign funds. Nobody can say for certain how the June 8th Las Vegas Justice of the Peace Department 3 election will turn out, but everyone is sure it will be a hard fought endeavor for all involved.

US Government Grants For An Elder

All we wanted in life is to love and be loved. One of the people that have given us a genuine love is our father and mother. Our parents have worked very hard to gives us a good future. Their sacrifice is measured of how much they love us. Their devotion is truly an inspiration and blessing. They are worth emulating and following for they have truly made their marks on our hearts forever.

With how fast-paced our culture today, being a senior citizen is quite difficult. That is why the government is giving grants to the older people. Aside from their pension which can benefit them with savings, the government is taking steps to increase grant funds to home and community based support services. They have prioritized the elderly and here are the few programs that help our elderly parents:

Care giving program - It assures that are old people receives hot and delicious food prescribed to them and also a provision of groceries for senior citizens who are not able to leave their homes. Caregivers also assist and help with household chores which are too difficult for the elderly.

Nutrition program - It is one of the human aspect that the government pays attention especially for our senior citizens which needs this type of program. Lunch programs and meals service are not the only component to this program but it pays attention to the diet and exercise appropriate for the old people.

Transportation - When it comes to vehicle assistance, the government provides a bus for the old people to have a free ride during special occasions and when they need to travel to have their errands and also with their medical visits to the hospital or clinic.

Other grants such as rental and food stamps are also provided to those whose retirement fund is not enough to support their needs. Indeed, our elders are important and must keep them healthy and well provided in all aspects in life. If it was not for them, we are not here in this world.

2012 - It's Not The End Of The World

Emmerich's film 2012 caused a big panic, and all the disaster-porn films we've seen for the last 50-60 years or so is scaring the heck out of viewers. So badly are they scared of the end that they are watching the same movies of disaster, over and over, with different actors, different titles, and different producers - all aimed to scare you and empty your pockets.

Do you think the world is coming to an end? The World Isn't Coming To An End, it's just Hollywood, trying to make a buck.

Let's get real. Let's discuss some of what's going on:

1. Rumor: The World Ends With Planetary Alignment and the repositioning of the Earth along the Galactic Equator .... are they nuts! The phenomena of placement of the stars and galaxies in space is not new. These things all have occurred before, and it wasn't the end of the world then and it won't be now. Actually, the date predicted, Winter Solstice, 2012 is not as significant as other astronomical phenomena happening before this. This is just fear-mongering of the formerly unemployed ' of the world writers' with nothing better to do than create movies to scare the smiles off of little kids.

2. There is no Mayan Prophesy says the world is coming to an end. There is no known prophesy that the world is coming to an End and whoever said that should know that it can't be. The records of the Maya civilization were effectively destroyed, like all other Meso-American histories by the Spanish Conquistadors, who just pillaged the valuables, raped the women and then killed the men and sometimes the women, but not necessary in that order. And, what information that was kept - was kept in secret archives to keep the truth away from the public because it would destroy the Catholic Church. The evidence indicated that the majority of the Meso-American population was, in fact, the lost tribes of Israel. This was written by Franciscan Monks at the time of the invasion, and British and other archeologists later. The actual Mayan Prophesy was simple - 'Live naturally, in natural time, or your biosphere (Earth - our mother ship) would not survive. We'll we did it. No lying about that. For the past umpteen years, we have been just like conquerors, raping, murdering, and killing mother earth. OOPS! I didn't do it - you didn't do it - the politicians allowed it - all for greed. Oil, Gold, Silver - rape the earth suffers the consequences. The end date of the Mayan Calendar had nothing to do with the end of the planet, it had to do with the end of an era.

2a. Note that when the Earth was first inhabited there was something of a 3 degree axis tilt and the planet was green, and water blue, and life was abundant. What by the name of God have we done to our mother?

2b. And now, YIKES, we're at 23 degree wobble now. Yes, something is happening, changes are occurring, but it's not the end. It scares people to think that changes are coming - people fear change. CHANGE IS GOOD!

2c. Will people will die? Of course, people are already dying. Yes, we've burned fossil fuels, destroyed our air, cut down our forests, created deserts where there were none before and previously the planet cleansed itself with great floods. People are dying, we are more aware since Hurricane Katrina, that things are not right due to global warming, and Tsunamis, great floods, and thousands more deaths in countries where floods were a rarity.

2d. And there are many species are dying. Faster than ever before species are disappearing. One indication that might be considered, or two, are the frog population which began disappearing a few years back, and the bees. We are impacting nature and we don't step lightly - our footprint is huge and visible, and we are destroying all of life without mistreatment of our mother.

2e. There are more diseases now, more horrible, more incurable - a sick society and planet produce all forms of diseases.

3. It's obviously human nature - It's obvious that the nature of the human being is to conquer. The continuous development of warfare, atomic, and nuclear weaponry is solely aimed at the destruction of mankind and hurting the planet. Previously, we had been the only big bully playing with nukes, now every schoolyard bully has them and someone is likely to play war games just to demonstrate my 'rocket' is bigger than your 'rocket'.

3a. Human Belief in Ancient Religions - I must mention this, because this is the greatest manipulation of human beings on Earth. Sorry, priest, ministers, rabbis, I honor you all for what you know, but your DOGMA is not helping the situation. Each one of you has chosen an individual branch as part of the Tree of Life, and none of you are on the Expressway to God. Please stop telling your people they are sinners - as men of God, many of you have been caught with your own pants down around your ankles and some honey taking some money for some SINFUL and LUSTFUL experience you needed to have. It may not have been you, but we all know of whom I speak. I am not judging you - just stop judging others and stop playing the blame game which results in guilt. As you know - guilt has absolutely no survival value, it is responsible for many illnesses that do not resolve and result in death. Stop guilting others, or ...

3b. Humans Mistreat Each Other and Mother Earth - imagine all the drilling, the cutting of trees, the burning of fields, everything normal and beautiful of earth destroyed by greed to steal the resources and be billionaires, all at the cost of our mother. Imagine our planet as a great big fluffy dog, filled with life. And the dog feels the burring of something drilling into it - just like a flea. And another, burning like burning the trees - the dog begins to scratch and shake fiercely and the fleas fall off. You got a parachute for when this happens to us?

4. The Mayan Calendar - Interestingly enough ends on the Winter Solstice, 2012. Why, not because it's the end of the world - it's the end of the 5th Cycle of Life on the Planet. The 6th Cycle that begins immediately thereafter is an Age of Enlightenment. It's sounds like an exciting time to be alive - so get prepared!

WELCOME - this is reality.

Many of us will fall off, many of us will die. Those who are not prepared, and those who think they are better or more greater, more important or more powerful than Mother Earth that we live on, will suffer.

Richard Branson is really making his fleet of Intergalactic Space ships to take the rich and wealthy off the planet, just like Roland Emmerich has set of Arks in his movie. Branson's ticket price is much cheaper.

I'D RATHER STAY HERE ON EARTH

In 1987, the Harmonic Convergence, which was written about by Dr. Jose Arguelles, and my participation in it - by doing long travels through endless ruins, culminating at the El Tule Tree in Oaxaca in Mexico, spoke the prophesy that we had 25 years left of life as we knew it. We must return to natural, non-destructive living. Oops Earthlings, you blew it!

The cards are on the table. Disasters are not caused by nature but by those politicians who paid no heed to the warnings 20-30 years ago. Politicians refused to grant health to the planet at Kyoto and the disastrous earth changes continued. Want someone to blame - Blame George W. Bush!

What can the scenario possibly be -- to cause the end of life as we know it? Who knows, asteroids, meteorites, some crazy Anti-Semitic Iranian ex-president who stole the presidency from the people in order to try to wipe out the State of Israel, some angry Korean president who is dying because of his anger at the United States over a 60 year old situation, or errors by our own major powers in their thinking that nuclear energy is stable enough to survive what our earth going through with hurricanes, tsunamis, typhoons, earthquakes, and worse. All the time our earth, which I'd like to assimilate it to be life this big furry yellow dog who it tired of all the baggage she's carrying and begins shaking off the fleas. But, the fleas are US!

Managing The Utility "Revenue Requirement"

Water rate increases and service fee hikes must be justified. When emotions run high at city council meetings or utility board gatherings, it is important to understand the budget structure of most utility service providers. In fact, Water Rate Consultants generally encourage continual communication of how budget processes work when utilities are considering raising service rates.

All too frequently, utility service providers fail to effectively communicate why rate increases might be necessary or they fail to effectively plan so as to keep rate increases to a minimum. Understanding the utility "Revenue Requirement" is central to any discussion of water or utility service rates.

For service utilities, the Revenue Requirement is generally understood to be the amount of revenue necessary to pay for operating or ongoing company operations. Operating management costs including personnel, staff, and all other necessary expenditures to keep the systems working would be included. Also included in this figure would be payments to service previously incurred debt. These are usually entered into by utilities needing to replace aging plant and equipment or for other major outlays.

Of course if all utilities never had any major plant failures and if all operating costs remained constant, the Revenue Requirement wouldn't change much over time. As many customers have seen though, a constant level of activity is difficult to achieve. Utilities frequently experience system failures or have plant and equipment simply reach the end of useful life. Many things can change a utility's Revenue Requirement. Among these are: System Failures Plant and Equipment Upgrades Changes in Regulatory Environment

Water and utility service providers are frequently called to fix problems with the infrastructure or delivery systems. Each instance costs real money. Major renovations can also involve the necessity to secure external financing. Changing environmental rules also present challenges as new regulations may require the expenditure of funds to comply.

Each utility that must meet one of these challenges usually experiences an increase to its Revenue Requirement. Many organizations simply pass costs on to consumers in the form of rate increases. In the case of big projects, the costs are high enough to justify funding the project using debt instruments. Debt service escalates the Revenue Requirement, but spreads the cost over time. When small providers serving a few thousand customers are faced with replacing a treatment plant costing several million, it makes sense to manage these costs over time. Passing on huge costs to the consumer base in the short term would be difficult.

Borrowing to meet big capital expenditures is of course one option to cover things like plant and equipment upgrades. This is probably the most common way to meet large capital funding needs and is also a common reason for utilities to request rate increases from the customer base. Borrowing spreads the cost of major renovations or improvements out many years but also adds to the revenue requirement for several years.

Utilities try to get the most useful service life from all plant and equipment, but over time, the risk of failure for some facilities may increase. Financial planning for future replacement costs as well as for unforeseen emergencies is the best solution to keeping customer rates under control. Communication with customers about these issues is imperative to keeping the user base informed.

The Dire Need For More Money In The U.S.

People need money and that is the main reason they go online looking for grants. Now that Obama is President, it almost appears that some people voted for him because they thought they could get free things from him. While the Democrats do have a history of handing out a good portion of our money, it is unreasonable to think that Obama will just give out money. They might have thought that the government would cut everyone a stimulus check similar to what George W. Bush did several years ago.

Many Americans are having a very difficult time right now financially and they are looking for ways out anywhere they can find them. Because the stimulus bill is so big and so many companies seem to be getting bailed out, people might be under the impression that there is money for them there as well. They don't understand or care that all the money from the stimulus bail out is coming from our own taxpayer dollars. It will be our children that will end up paying for much of this in the form of higher taxes.

It is very sad when you think about the numbers of people that hope they can make some kind of score off the Obama presidency. While the government is there to help us all and maintain order in our society, it is not there to just give us things. Most of us have gotten into a bad financial position because we refuse to save and spend more than we have. That is not a problem that is any business of our government.

There are ways to profit from the stimulus bill and that is in the form of some of the new jobs that were created or old ones that were saved by the bill. You might be able to get one of the newly created jobs and make a better life for yourself that way. However, that will be the only way to get some of the stimulus money unless Obama somehow decides to give a rebate check to everyone, which is highly unlikely.

The stimulus act was mainly to help some businesses and state governments get their feet back on the ground after a terrible financial spell. There is little in it for the common person and as always, it is very complicated to learn what is available and how to apply for it if you qualify. It seems that no matter how much you need additional funds, the stimulus package is probably not your solution.
