An election for the Las Vegas Justice of the Peace Department 3 position is getting competitive. 58 year old Lary Lamoreux, and 48 year old Janiece Marshall, both attorneys from the Las Vegas area, are challenging incumbent Tony Abbatangelo. As the election draws near, the race to unseat the 17 year incumbent is starting to get very heated.
Justices of the Peace are in place to prepare procedural aspects of cases before they move onto District Court. For example, they might set bail and handle arraignments. In addition, Justices also preside over small claims civil cases and misdemeanor cases.
A significant stain on the record of the incumbent has been used against him in this election. Following a no contest plea to one count of misdemeanor battery domestic violence last year, Tony Abbatangelo was sentenced to 6 months of community service and domestic violence counseling.
As part of his Justice of the Peace duties, Abbatangelo recently granted bail to an attempted murder defendant. The $7500 bail amount was a small fraction of the $100,000 bail amount that is usually set for attempted murder suspects. The defendant fled and critics are citing this as a mistake by Abbatangelo from the bench.
At the heart of the controversy surrounding the defendant's bail jump is the fact that this defendant is represented by the same attorney that represented Abbatangelo in his domestic violence case. Critics are pointing to this as another reason to not reelect Abbatangelo.
